Hale County District Attorney Wally Hatch will serve as Special Prosecutor in the case involving the death of a Frenship student in late October. Lubbock's DA Matt Powell recused himself from the legal proceedings last month, citing a personal conflict.

17-year-old Connor Mercer was lying in the roadway in the 88-hundred block of Upland Avenue when he was struck by a pickup truck. Lubbock police report test results show mercer had a blood alcohol content almost three times the legal limit for an adult.

TABC investigators are recommending charging a friend of Mercer's with minor in possession of alcohol, and an adult relative of that underage suspect with providing alcohol to a minor.
