Gutierrez files for petition to remove Hernandez from council

The official affidavit for a recall petition to remove Victor Hernandez from the city council was filed by a group that includes a former county commissioner. Ysidro Gutierrez and his colleagues will have to get 30 percent of District 1 voters to sign the petition.

That's 448 signatures in order for the petition to pass. Ten percent of those who sign must certify that they voted for Hernandez in the last election. Gutierrez is confident in getting the signatures.

"We're going to be going door to door." Said Gutierrez. "We are going to be speaking face to face with the voters of this district. I believe that with the explanation that we provide, there will be sufficient numbers within the district that will agree and sign the petition."

Gutierrez will have thirty days to turn in the signatures to the city secretary. If the petition is verified, Hernandez would have five days to resign before a recall election is called.
