Rosendo Rodriguez loses state court appeal

The Texas Court of Criminal appeals denied death row inmate Rosendo Rodriguez' appeal Wednesday.

Rodriguez was convicted in 2008 of killing 29-year-old Summer Baldwin, who was 10-weeks pregnant. Her body was found in a suitcase later recovered from the city's landfill.

Rodriguez is also accused of murdering 16-year-old Joanna Rogers and disposing of her body in a similar manner.

His appeal claims ineffective counsel during the investigation, trial, and previous appeals.

Last April, FOX 34 reported Rodriguez claimed abuse by his father to further his chances of escaping lethal injection.

The state court denied Rodriguez' appeal without comment. He can still appeal his conviction to a federal court.
