The Fifth Circuit Court of Appeals has refused to delay Tuesday's scheduled execution of a convicted murderer with ties to Lubbock.
Cleve Foster was sentenced to death for his role in the 2002 slaying of Mary Pal in Forth Worth.
Foster was also named the chief suspect in the 2001 Tarrant County murder of Rachel Urnosky, who was originally from Lubbock. Foster never went to trial for that murder.
Foster claims he had poor legal representation at this trial an in earlier appeals. Foster's lawyers say they'll take his latest appeal to the U.S. Supreme Court, which stopped his execution three previous times.
