3 lawsuits filed in Terry County over crop production

Three lawsuits filed in Terry County District court claim West Texas Guar Inc. of Brownfield has failed to pay farmers what they're owed for their 2013 crop.

The company contracts growers to deliver the bean to its plant to be processed. About 20 farmers, with a total of almost $4 million in claims, have also filed a petition in Lubbock federal court, asking that the company be placed under an involuntary Chapter 11 bankruptcy. That would include putting a third party trustee in control of West Texas Guar's assets.

Attorneys for the plaintiffs say up to 400 farmers who had contracts with the company could be owed a total of $18 million.

Fernando Bustos is representing four of the farmers.

"West Texas Guar has failed and refused to pay for any of the crops. To my knowledge, not a single farmer has been paid a single dime for their 2013 crop that they have delivered."

Representatives for West Texas Guar Inc. have not returned our calls.
